NDIS SERVICE AGREEMENT

This service agreement is made under the National Disability Insurance Scheme (NDIS) for the provision of supports.

1. Parties

This agreement is between:

  • Provider: [Provider legal name], ABN [ABN] (“the Provider”), and
  • Participant: [Participant full name], NDIS number [NDIS number] (“the Participant”)
  • Participant’s representative (if applicable): [Representative name and relationship, e.g. plan nominee]

This agreement starts on [start date] and ends on [end date], unless ended earlier under clause 11.

2. Purpose

The Participant has an NDIS plan and wishes to purchase supports from the Provider to help pursue the goals in that plan. This agreement records the supports the Provider will deliver, their price, and the terms both parties agree to.

3. The NDIS and this agreement

Both parties agree that this agreement is made for the purpose of providing supports under the Participant’s NDIS plan, in accordance with the rules of the National Disability Insurance Scheme.

4. Schedule of supports

The Provider agrees to deliver the following supports:

All prices are consistent with the NDIS Pricing Arrangements and Price Limits in effect at the time the support is delivered. If the Pricing Arrangements change, prices under this agreement will be adjusted to remain within the applicable limits, and the Participant will be notified.

5. Price and payment

The Participant’s supports under this agreement are [NDIA-managed / plan-managed / self-managed].

  • NDIA-managed: the Provider will claim payment directly from the NDIA after supports are delivered.
  • Plan-managed: the Provider will invoice the Participant’s plan manager, [plan manager name and email], with payment due within [e.g. 14 days].
  • Self-managed: the Provider will invoice the Participant directly, with payment due within [e.g. 14 days].

6. Cancellations

If the Participant needs to cancel or change a scheduled support, they will give the Provider at least [notice period consistent with the current NDIS Pricing Arrangements, e.g. 7 clear days] notice. Where a support is cancelled at short notice, or the Participant is not present for a scheduled support, the Provider may claim for the support in accordance with the short-notice cancellation rules in the current NDIS Pricing Arrangements and Price Limits.

7. Responsibilities of the Provider

  • Deliver the supports in the schedule to a standard consistent with the NDIS Practice Standards and the NDIS Code of Conduct;
  • Treat the Participant with courtesy and respect, and involve them in decisions about their supports;
  • Communicate openly, honestly and in a timely way, including about any changes to scheduled supports;
  • Protect the Participant’s privacy and confidential information;
  • Keep accurate records of the supports delivered and issue regular statements or invoices;
  • Give the Participant the required notice before ending this agreement.

8. Responsibilities of the Participant

  • Tell the Provider about the supports they want and how they would like them delivered;
  • Treat the Provider and its workers with courtesy and respect;
  • Give the required notice for cancellations under clause 6;
  • Tell the Provider promptly if their NDIS plan is replaced, suspended or changed, or if they stop using the Scheme;
  • Pay (or arrange payment of) invoices on time under clause 5.

9. GST

The parties agree that the supply of supports under this agreement is a supply of one or more reasonable and necessary supports specified in the statement of supports included in the Participant’s NDIS plan. To the extent the requirements of section 38-38 of the A New Tax System (Goods and Services Tax) Act 1999 are met, the supports supplied under this agreement are GST-free.

10. Changes to this agreement

Any changes to the supports, prices or terms in this agreement must be agreed by both parties in writing, and may be recorded by signing an updated agreement or a written variation.

11. Ending this agreement

Either party may end this agreement by giving [e.g. 14 days] written notice. If either party seriously breaches this agreement, the other party may end it immediately. No exit fees apply beyond amounts owed for supports already delivered.

12. Feedback, complaints and disputes

The Participant can raise feedback or complaints with [contact name] on [phone / email]. If the Participant is not satisfied with the outcome, they can contact the NDIS Quality and Safeguards Commission on 1800 035 544 or via ndiscommission.gov.au.

Frequently asked questions

Does every NDIS participant need a service agreement?

A written agreement isn’t legally mandatory for every support, but the NDIA strongly recommends one, and for registered providers a clear agreement is the practical way to evidence your obligations under the NDIS Practice Standards. It protects both sides: the participant knows exactly what they’re buying and at what price; you have agreed payment and cancellation terms before delivering supports.

Is an electronically signed service agreement legally binding in Australia?

Yes. Electronic signatures are recognised under the Electronic Transactions Act 1999 (Cth) and equivalent state and territory legislation. A GoodSign agreement also carries a full audit trail — who signed, when, and from where — which is stronger evidence than a scanned paper signature.

Can a participant’s representative or nominee sign?

Yes. Where a participant has a plan nominee, child representative or guardian, address the signing request to that person — the template includes a representative signature block for exactly this case.

Should the agreement mention GST?

Yes — include a GST clause. Most NDIS supports supplied under a service agreement to a participant with a current plan are GST-free where the requirements of section 38-38 of the GST Act are met, and a statement in the agreement is part of meeting those requirements. Confirm your specific supports with your accountant.

What cancellation terms should I include?
